By consigning equipment with Stone Trading and Repairs Company, LLC, buying equipment from Stone Trading and Repairs Company, LLC, or entering Stone Trading and Repairs Company, LLC’s yard, facilities, or premises (the “Premises”), you agree to the following terms. Consigned equipment is advertised and sold on your behalf for a 10% commission, with no guarantee of sale, price, or time to sell; all consigned equipment is stored on the Premises at your sole risk, Stone Trading and Repairs Company, LLC is not liable for theft, loss, or damage, and it is your responsibility to maintain insurance or bear any loss. If Stone Trading and Repairs Company, LLC believes a price change is needed to facilitate a sale and you decline to adjust, Stone Trading and Repairs Company, LLC may charge storage of $150 per month per unit until the price is adjusted, the item is sold, or it is removed, and may require removal of equipment at your expense. All equipment is sold “AS IS, WHERE IS,” with all faults and no warranties of any kind (express or implied); you are solely responsible for inspection and determining suitability, and, unless otherwise disclosed in writing, Stone Trading and Repairs Company, LLC states that, to the best of its knowledge, equipment sold is free of liens and that it has the right to transfer title. Risk of loss passes to you when you pay and sign a bill of sale or when you remove or attempt to remove the equipment from the Premises, and you are solely responsible for loading, transport, and insurance thereafter. The Premises contain heavy equipment and other hazards, and by entering you voluntarily assume all risks of injury, death, or property damage and, to the maximum extent permitted by law, release and agree to indemnify and hold harmless Stone Trading and Repairs Company, LLC, its owners, officers, employees, and agents from any claims arising out of your presence on the Premises or your use, loading, or transport of equipment, except to the limited extent caused by Stone Trading and Repairs Company, LLC’s gross negligence or willful misconduct. These terms are governed by Texas law, and Stone Trading and Repairs Company, LLC may update them from time to time by posting revised terms on this website.
